Your privacy is important to us and we have prepared this Privacy Policy to explain to you how we collect, use and share your personal information. This Privacy Policy applies to the Inferno Website (the "Site") offered by Clarity Games L.L.C. (“Clarity,” “we” or “us” ) and any other applications, interactive features, and resources offered by Clarity, including those through Websites, mobile devices, or third-party platforms, including social media platforms (together, with the Site, the "Services"). Please read this Privacy Policy carefully. By using the Services, you affirm that you have read and understand this Privacy Policy and that you consent to the collection and use of your personal information as outlined in this Privacy Policy. When you use the Services, you also agree to our Terms of Use (the “Terms”).

  1. Information You Voluntarily Submit

We may collect information that personally identifies you, such as your name, address, email address, credit card information, wallet information, billing information, or other data which can be reasonably linked to such information ("Volunteered Information") if you choose to share such information with us.  For example, you may be required to provide us with certain Volunteered Information to register with the Services, sign up for our Mintlists, sign up for certain services (such as text alerts, mobile phone applications, and other communications services), subscribe to a newsletter, enter sweepstakes, contests, or other promotions, and at other times.  The decision to provide this information is optional; however, if you decide not to provide certain information, you may not be able to use certain features of the Services.

  1. Information We Automatically Collect

We automatically collect certain information ("Logged Information") to help us understand how our users use the Services. We may collect information about the computer or device you use to access our Service, including the hardware model, operating system and version, MAC address, unique device identifier (“UDID”), phone number, International Mobile Equipment Identity (“IMEI”) and mobile network information. We may also automatically collect and use the data contained in log files. The information in log files may include your IP address, your ISP, the Web browser you used to visit the Services, the time you visited the Services, which web pages you visited on the Services, and other usage data.

Cookies

We may use cookies (a small file containing a string of characters that uniquely identifies your Web browser) and Web beacons (an electronic file placed within a Web site that monitors usage).  We may use cookies and Web beacons to improve the quality of the Services.  Most Web browsers are initially set up to accept cookies, but you can reset your Web browser to refuse all cookies or to indicate when a cookie is being sent.  However, certain features of the Services may not work if you delete or disable cookies.  Certain of our Service Providers (defined below) may use cookies and Web beacons in connection with the services they perform on our behalf.

Analytics

Blockchain Technologies

The Services involve the use of Game Tokens (as described in the Terms) that reside on certain Blockchain platforms, including Ethereum and are held using wallet technologies that users select.   To interact with the Services, we use APIs that are provided by the wallet providers (for example, Coinbase and Metamask).  Your use of the services provided by these wallet providers is governed by their respective privacy policies.  Coinbase’s privacy policy is located at https://www.coinbase.com/legal/privacy and Metamask’s policy is located at: https://consensys.net/privacy-policy/.  If you use a different wallet provider, you should review their applicable privacy policy.

We may also use technologies and third-party technologies that collect and analyze publicly available information contained on blockchain platforms, including information regarding Game Token holders.  

Do Not Track

Our Services do not respond to web browser “do not track” signals or other mechanisms that provide consumers the ability to exercise choice regarding the collection of Logged Information about an individual consumer’s online activities over time.  Visit www.donottrack.us to find out more about “do not track.”

  1. How We Use and Share Your Information

We do not sell your information to third parties and we will not otherwise disclose your information to third parties without your express permission or as expressly disclosed in this Privacy Policy.

Use of Your Information.

We use your information (both your Volunteered Information and Logged Information) for internal purposes only, such as to send service notifications, to customize the content you see, to improve the Services, to conduct research, to solicit your feedback and input about the Services, and to provide more relevant features and content through the Services.  Volunteered Information and Logged Information may be combined with data collected from other sources so that we may further improve the relevance of products, services, and advertisements offered on or through the Services.

We may send you marketing communications and materials to keep you informed of new products, promotions, and to provide other information we think may be of interest to you. To stop receiving these communications, you may change your preferences clicking any "unsubscribe" link in any marketing email you receive from us or by contacting us as described in Section 1 above. It may take up to 48 hours to process your request. Note that we will continue to send you administrative and service communications (including updates relating to your account.)

We may also conduct interest-based advertising on both the Services and unaffiliated third-party sites. Disclosures to Service Providers 

From time to time, we may establish a business relationship with other persons or entities whom we believe trustworthy and whom we have asked to confirm that their privacy practices are consistent with ours ("Service Providers").  For example, we may contract with Service Providers to provide certain services, such as payment processing, data management services, Web hosting and Web development.  We provide our Service Providers with the information reasonably necessary for them to perform these services.  Each Service Provider must agree (a) to implement and maintain reasonable security procedures and practices appropriate to the nature of the information involved in order to protect your information from unauthorized access, destruction, use, modification, or disclosure and (b) not to retain, use, or disclose the information for any purpose other than for the specific purpose of performing the services for us, or as otherwise permitted by law.

Other Disclosures

Aggregate Information. We may use and disclose to third parties, certain aggregated Logged Information regarding the Services (e.g., number of visits, page views, number of registered users who reside in a particular geographic location, etc.).  However, such aggregated information does not identify you individually.

To Affiliated Entities.  We may share your information with entities controlling, controlled by, or under common control with Clarity.  In the event that Clarity is merged, sold, or in the event of a transfer of some or all of our assets, we may disclose or transfer your information in connection with such transaction.

For Legal Reasons. In certain instances, we may disclose your information when we believe it is necessary to identify, contact, or bring legal action against persons or entities in order to protect Clarity or our users, prevent fraud or misuse of the Services, or when we believe that the law or legal process requires such disclosure.

  1. Public Areas and External Sites.

Whenever you voluntarily post information to any community or interactive areas of the Services, such information can and may be accessed by the public.  We urge you not to post any of your personal information in any publicly accessible area of the Services – if you do, any person or entity with access to such information could potentially use it for any purpose, including sending unsolicited communications.

The Services may enable you to conduct transactions on one or more blockchain networks (e.g., Ethereum).  By their nature, transactions conducted on blockchain networks are public and visible to other users of those networks.

The Services may contain links to, or advertisements about, third-party websites, applications or other properties (“Other Sites”).  Other Sites may also reference, advertise, or link to the Services.  We do not endorse or sponsor Other Sites and are not responsible for the privacy practices or the content of Other Sites.  The practices described in this Privacy Policy do not apply to information gathered by third parties through Other Sites.  We encourage you to read the privacy policies of every website that you visit.

  1. Security

The security of your Personal Information is important to us. We use standard security procedures and practices appropriate to the nature of the information in an effort to protect information from unauthorized access, destruction, use, modification or disclosure. We also require our Service Providers to implement and maintain reasonable security procedures and practices appropriate to the nature of the information we share with them. No data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect Personal Information, we cannot and do not guarantee or warrant the security of any information you transmit to or from the Service, and you do so at your own risk.

  1. Rights of European Union Residents

For residents of the European Union, the European Union General Data Protection Regulation (“GDPR”). requires that Clarity take particular measures to protect the personal data of European residents. If there is any conflict between this policy and the GDPR, the GDPR principles shall govern with respect to residents of the European Union.Under the GDPR, you have the right to request a copy of your personal data stored at Clarity (Article 15 GDPR). You also have the right to request corrections (Article 16 GDPR), deletion (Article 17 GDPR) or restriction (Article 18 GDPR) of your personal data stored at Clarity. In order to meet these requests, we will ask you to provide a contact email address. If you are a European resident and are dissatisfied with the handling of your personal data by Clarity, you have the right to object to processing of your personal data at any time (Article 21 GDPR).   1. California Residents 

These additional notices are provided under the California Consumer Privacy Act (“CCPA”) and apply to California residents in addition to the other provisions of this Privacy Policy.

  • You may request, no more than two times each year, that we disclose to you the following for the 12-month period preceding our receipt of your request:
    • The categories of personal information we have collected about you; 
    • The categories of sources from which the personal information is collected;
    • The business or commercial purpose for collecting your personal information;
    • The categories of third parties with whom we share personal information; and
    • The specific pieces of personal information we have collected about you.
  • You may request that we delete any personal information that we have collected from or about you.  Except as provided under the CCPA, we will delete such information in response to your request.

In order to respond to your requests, we may need to verify your identity. We will not discriminate against you in the provision of the Services in response to your exercise of these privacy rights. We will respond to your request within 45 days of receipt of your request, after verification, unless we need additional time, in which case we will let you know and may extend the period an additional 45 days as permitted by the CCPA.

  1. Children's Privacy Statement

We do not knowingly collect personally identifiable information from children under the age of 13 (or under age 16 where the GDPR requires consent for the collection of personal data). If we become aware that we have inadvertently received personally identifiable information from a user under such age, we will delete such information from our records. 

 

  1. Change.

Clarity may, in its sole and absolute discretion, change this Privacy Policy from time to time. All changes to the Privacy Policy will be effective when posted, and we will provide notification of such changes to you via the Services or contact information you may have provided to Clarity. In order to continue using the Service following any changes to the Privacy Policy, you must agree to be bound by such changes. If you object to any such changes, your sole recourse shall be to cease using the Services.
